1. Definitions

• Platform: Trackdaytickets.com
• User: any natural or legal person using the Platform
• Seller: User offering a Ticket
• Buyer: User purchasing a Ticket
• Ticket: access right to a trackday or circuit event
• Trackday: motorsport-related driving activity on a closed circuit
• Organizer: third-party entity organizing the Trackday
• Agreement: agreement concluded between Buyer and Seller

2. Applicability

These Terms apply to all use of the Platform. By creating an account or using the Platform, the User agrees to these Terms.

3. Role of the Platform

Trackdaytickets.com operates solely as an online marketplace and intermediary. The Platform is not a party to the Agreement between Buyer and Seller and does not organize Trackdays.

4. Registration and Account

You must be at least 16 years old to create an account and use the Platform. Users must provide accurate information and are responsible for all activity under their account. Accounts may be suspended in case of misuse or fraud.

5. Offering Tickets

Only valid and transferable Tickets may be offered. Sellers guarantee legal ownership and authority to sell. Tickets may not be offered above their original face value. Fraudulent listings are prohibited.

6. Purchasing Tickets

Buyers are responsible for checking all Trackday requirements. Purchases are final and non-refundable unless stated otherwise by the Organizer. The statutory right of withdrawal is excluded pursuant to Article 16(l) of Directive 2011/83/EU.

7. Prices and Payments

Prices are set by Sellers and may not exceed the original face value of the Ticket. Trackdaytickets.com charges service fees, which are clearly displayed before purchase. Payments are processed via the Platform's payment provider. Payouts to Sellers are processed after the event has taken place.

8. Event Changes or Cancellations

Event changes are the responsibility of the Organizer. Refunds follow the Organizer's policy.

9. Risk and Liability

Participation is at the User's own risk. The Platform is provided "as is" and we do not guarantee uninterrupted availability. The Platform is not liable for injury, damage, or indirect loss. Liability is limited to service fees paid.

10. Fraud and Abuse

The Platform may suspend accounts, cancel transactions, and cooperate with authorities.

11. Intellectual Property

All intellectual property rights belong to Trackdaytickets.com.

12. Privacy

Personal data is processed in accordance with GDPR and the Privacy Policy.

13. Governing Law

These Terms are governed by Dutch law. Disputes shall be submitted to the competent court in the Netherlands.

14. Amendments

Trackdaytickets.com may amend these Terms at any time. The latest version applies. Continued use of the Platform after changes constitutes acceptance of the amended Terms.
