1. Definitions

  • Platform: Trackdaytickets.com
  • User: any natural or legal person using the Platform
  • Seller: Organizer or User offering a Ticket through the Platform
  • Buyer: User purchasing a Ticket
  • Ticket: access right to a trackday or circuit event
  • Trackday: motorsport-related driving activity on a closed circuit
  • Organizer: third-party entity organizing the Trackday
  • Agreement: agreement concluded between Buyer and Seller
  • Additional Sales Channel: use of the Platform by an Organizer to offer their own Tickets in addition to their own sales channels
  • Resale: offering by a User of a previously and lawfully obtained Ticket to other Users

2. Applicability

These Terms apply to all use of the Platform. By creating an account or using the Platform, the User agrees to these Terms.

3. Role of the Platform

Trackdaytickets.com operates solely as an online marketplace and intermediary. The Platform is not a party to the Agreement between Buyer and Seller and does not organize Trackdays. The Platform facilitates three types of use: (a) Listing — displaying Trackday events on the Platform without a transaction taking place via the Platform; (b) Additional Sales Channel — Organizers offer their Tickets through the Platform in addition to their own sales channels; (c) Resale — Users offer previously purchased Tickets to other Users. In all cases the Platform acts as an intermediary.

4. Registration and Account

You must be at least 16 years old to create an account and use the Platform. Users must provide accurate information and are responsible for all activity under their account. Accounts may be suspended in case of misuse or fraud.

5. Offering Tickets

Only valid and transferable Tickets may be offered. Sellers guarantee legal ownership and authority to sell. Fraudulent listings are prohibited. In the case of Resale, Tickets may additionally not be offered above their original face value. Where the Platform is used as an Additional Sales Channel, the Organizer sets the price of their own Tickets.

6. Purchasing Tickets

Buyers are responsible for checking all Trackday requirements. Purchases are final and non-refundable unless stated otherwise by the Organizer. The statutory right of withdrawal is excluded pursuant to Article 16(l) of Directive 2011/83/EU.

7. Prices and Payments

Prices are set by the Seller, subject to article 5. Trackdaytickets.com charges service fees, which are clearly displayed before purchase. Payments are processed via the Platform's payment provider and held by the Platform until after the event. Payouts to Sellers — depending on the type of use: Organizers or Users — are processed after the event has taken place, less the service fees.

8. Event Changes or Cancellations

Event changes are the responsibility of the Organizer. Refunds follow the Organizer's policy.

9. Risk and Liability

Participation is at the User's own risk. The Platform is provided "as is" and we do not guarantee uninterrupted availability. The Platform is not liable for injury, damage, or indirect loss. Liability is limited to service fees paid.

10. Fraud and Abuse

The Platform may suspend accounts, cancel transactions, and cooperate with authorities.

11. Intellectual Property

All intellectual property rights belong to Trackdaytickets.com.

12. Privacy

Personal data is processed in accordance with GDPR and the Privacy Policy.

13. Governing Law

These Terms are governed by Dutch law. Disputes shall be submitted to the competent court in the Netherlands.

14. Amendments

Trackdaytickets.com may amend these Terms at any time. The latest version applies. Continued use of the Platform after changes constitutes acceptance of the amended Terms.
